norua Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between you and Restmesh Inc ("Restmesh", "we", "us"), 2439 152nd Ave NE, Redmond, WA 98052, United States. Restmesh operates the norua platform, which includes:

norua — the point-of-sale software used by restaurants and their staff (the "Merchant") to take orders and accept payments;
norua Go and the order.openpos.site website — the customer ordering experience used by diners to order ahead, join a waitlist, or book a table at a participating Merchant;
the openpos.site website and the services these products connect to.

By using any of them you agree to these Terms. Sections 1–3 apply to everyone; Section 4 applies to Merchants; Sections 5–6 apply to customers of a Merchant; Section 7 (text messages) applies to anyone who gives us a mobile number; Sections 8–12 apply to everyone. Our Privacy Policy explains how we handle personal information and is part of these Terms.

1. Who we are, and who the Merchant is

norua is a tool operated on behalf of the Merchant that uses it. When you order from a restaurant through norua Go or order.openpos.site, your purchase is from that Merchant: the Merchant prepares the food, sets prices, taxes and fees, and is responsible for the order. Restmesh provides the software that carries the order and the payment, and is not the seller of the food or a party to the sale.

2. Accounts and sign-in

Merchant staff sign in with credentials issued by their Merchant. Customers sign in with a mobile number and a one-time code sent by text message.
You must provide accurate information and keep your credentials to yourself. You are responsible for activity under your account until you tell us it has been compromised.
You must be at least 18 years old, or the age of majority where you live, to place an order or hold an account.

3. Acceptable use

You may not use the platform to break the law, to interfere with its operation or security, to send unsolicited or deceptive messages, to scrape or bulk-collect data, or to access another person's or Merchant's data without permission. We may suspend or terminate access that violates these Terms.

4. Merchant terms

The Merchant is responsible for its menu, pricing, taxes, tips and fees, order fulfillment, refunds, and for complying with the laws that apply to its business, including consumer-protection, tax and messaging laws.
The Merchant is the controller of the customer data it collects through norua and decides which features (such as customer messaging) are enabled. The Merchant must obtain any consents its customers' data and messages require.
Card payments are processed by third-party payment processors (for example Stripe or Worldpay) under their own agreements with the Merchant. Restmesh does not hold card funds and does not store full card numbers.
Subscription fees, hardware and any other commercial terms are set out in the Merchant's order form or agreement with Restmesh, which prevails over this Section if they conflict.

5. Ordering, pickup, waitlist and reservations (customers)

Prices, availability, preparation times and pickup windows are set by the Merchant and are estimates; the Merchant may cancel or modify an order it cannot fulfill and will refund what you paid for it.
Joining a waitlist or booking a table is a request to the Merchant. Missing a hold window may release your spot, as explained on the page where you joined.
Questions about a specific order, refund or receipt go to the Merchant you ordered from; the receipt shows its name and contact details.

6. Payments, gift cards and promotions (customers)

When you pay in the app or on the website, your card is charged by the Merchant's payment processor. Restmesh does not see or store your full card number.
Gift cards, stored value and promotions are issued by the Merchant, are subject to the Merchant's terms shown at purchase, and cannot be redeemed for cash except where the law requires it.

7. Text messages (SMS)

Program description. When you give a mobile number to a Merchant that uses norua — at checkout, when joining a waitlist, when booking a table, or when signing in — and check the box agreeing to receive text messages, we send transactional texts on that Merchant's behalf about your own order or visit: order confirmation, order-ready and pickup reminders, table-ready alerts, booking confirmations, receipts, and one-time sign-in codes. Messages come from the Merchant's name "via norua". We do not send marketing or promotional texts on this program.

Message frequency varies with your orders and visits. Message and data rates may apply. Check with your carrier for details.

Opt-out: reply STOP to any message to stop receiving texts from that number. You may receive one final message confirming you have opted out. Reply START to opt back in. Help: reply HELP to any message, or email support@openpos.site.

Consent is not a condition of purchase. You can order, join a waitlist or book a table without agreeing to receive texts; you will then not receive text updates about that order or visit. One-time sign-in codes are sent only when you request them.

Carriers are not liable for delayed or undelivered messages. Supported carriers include all major U.S. carriers. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes; see the Privacy Policy.

8. Intellectual property

The norua software, apps, websites, and their content are owned by Restmesh or its licensors and are licensed, not sold, to you for use under these Terms. Merchant menus, photos and names remain the Merchant's.

9. Disclaimers

The platform is provided "as is" and "as available". To the fullest extent permitted by law, Restmesh disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the service will be uninterrupted or error-free. Nothing in these Terms limits rights you have as a consumer that cannot be waived by law.

10. Limitation of liability

To the fullest extent permitted by law, Restmesh will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the platform. Restmesh's total liability for any claim relating to the platform is limited to the greater of USD 100 or the amount you paid Restmesh (not the Merchant) for the service in the 12 months before the claim.

11. Governing law; changes; termination

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Courts located in King County, Washington have exclusive jurisdiction, except where the law gives you the right to bring a claim elsewhere.
We may update these Terms; material changes will be reflected by updating the "Last updated" date above, and continued use after that date means you accept the updated Terms.
You may stop using the platform at any time. Customers can delete their account from the account page in norua Go or on order.openpos.site.
